The only problem with your arguements is that his grandson has no rights on the internet. The IPPA serves as a basis of rights for users of the internet over the age of 13. even if it's p2p or whatnot, he shouldn't have been using the internet...had his grandfather known he was doing it... he wouldn't have let him.
Also theres the fact that the computer SN is registered to his grandfather I'd presume, making his grandad responsible for everything done on their IP.
