You absolutely cannot get in trouble for breaking street date as a consumer. The only way Microsoft can legally go after stores is with proof of purchase (receipt) and even then they only go after the seller.

Anyway, Modern Warfare 2 is nice and all. But Modern Warfare 3 is sooooo much better...
